Welcome to Momstash. These terms are the agreement between you and us for using the app and the momstashapp.com website. We've kept them as short and readable as we could. Please read them, especially sections 5 (Momstash Pro), 7 (AI can be wrong) and 11 to 13 (the legal limits).

1. Who we are

These Terms of Use are an agreement between you and Mimi Studio d.o.o., a limited liability company organized under the laws of the Republic of Slovenia, with its registered office at Trubarjeva cesta 79, 1000 Ljubljana, Slovenia ("Mimi Studio", "we", "us"). They cover your use of the Momstash mobile application and the momstashapp.com website (together, "Momstash" or "the Service").

By downloading, installing or using Momstash you agree to these terms and to our Privacy Policy (https://momstashapp.com/privacy/). If you don't agree, please don't use Momstash.

2. What Momstash is

Momstash helps you keep the things you save from all over the internet in one place. You share a link or a screenshot to Momstash, from TikTok, Instagram, YouTube, Reddit, Pinterest, Google Maps, a website or anywhere else. Momstash reads it and turns it into something you can use: a recipe with ingredients and steps, a place on your map, a product, a film to watch, an article to read. You can organize saves into collections, plan meals, build grocery lists, and share posts with other Momstash users if you want to.

To do that, Momstash fetches the public post behind your link and uses AI to understand it. The Privacy Policy explains exactly how.

3. Who can use Momstash

You must be at least 16 years old to use Momstash. If you are under 18, or under the age of majority where you live, you may use it only with the permission and supervision of a parent or legal guardian, who accepts these terms for you. Momstash is not intended for children under 16.

4. Your account

You need an account to import links and screenshots, back up your library and use the Social tab. You create it in the app with a username and a password.

Keep your password to yourself. You're responsible for what happens under your account.
Tell us at [email protected] if you think someone else has used it.
Pick a username that doesn't impersonate anyone or infringe anyone's rights. We may ask you to change one that does.
You can wipe your data at any time in Settings → Storage & data → Reset everything, and you can delete your account entirely in Settings → Account & sync → Delete account. The Privacy Policy explains both.

5. Free access and Momstash Pro

5.1 Your first 14 days are free

Everyone gets 14 days of free access, counted from when your Momstash library or account is created. You don't need to enter any payment details, and free access never turns into a paid subscription on its own. Nothing is charged unless you choose to buy Momstash Pro.

During free access you can import up to 10 links per day (the day resets at midnight UTC), plus the other limits shown in the app. When the 14 days end, you need Momstash Pro to keep using the app.

Free access is offered once per account. Creating new accounts to get more free access isn't allowed.

5.2 Momstash Pro

Momstash Pro is an auto-renewing annual subscription. It gives you continued access to Momstash with unlimited imports, subject to the fair-use limits in section 5.4.

Price. The price is shown in the app before you buy, in your local currency, as set by the App Store for your country (for example US$29.99 per year in the United States). It includes any taxes the App Store adds.
Payment. Payment is charged to your Apple Account when you confirm the purchase.
Automatic renewal. Your subscription renews automatically for another year at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
Managing and cancelling. You can manage or cancel your subscription at any time in your Apple Account settings (iOS Settings → your name → Subscriptions, or from the Momstash Pro screen → Manage in the App Store). Cancelling stops the next renewal. You keep Pro until the end of the period you've already paid for.
Deleting the app, resetting your data or deleting your account does not cancel your subscription. We have no way to cancel an App Store subscription for you.
Restoring. If you reinstall Momstash or change phones, use Restore purchase on the Momstash Pro screen. Pro follows your Momstash account and the Apple Account that bought it.
Family Sharing is not available for Momstash Pro.

5.3 Refunds

Purchases are made through Apple, and Apple handles refunds under its own policies. We can't issue, reverse or override them. To ask for a refund, go to reportaproblem.apple.com. If you are a consumer in the European Union, your statutory rights, including any right of withdrawal, apply through Apple as the seller.

5.4 Fair use

"Unlimited" means you don't have a monthly or daily import quota in normal use. Every import costs us real money to process, so to stop abuse and runaway costs we apply generous automatic limits per account per day. They're far above what anyone saving things for themselves would reach. If you hit one, Momstash will ask you to try again later. We may adjust these limits, but not to take away the value of a subscription you've already paid for.

5.5 Price changes

We may change the price of Momstash Pro. A change never affects a period you've already paid for. Apple will notify you in advance where its rules require, and ask for your consent where required, so you can cancel before a new price applies.

6. Your content and the links you save

6.1 What you save stays yours

The links, screenshots, notes, collections, posts and everything else you put into Momstash ("Your Content") remain yours. We don't claim ownership of any of it.

You give us a limited, worldwide, non-exclusive, royalty-free permission to store, copy, process, transform and display Your Content, and the public content it points to, only as needed to run Momstash for you. That includes fetching the post, sending it to our AI and data providers (as described in the Privacy Policy), keeping a copy of its media in your library, and showing your posts to the people you chose. The permission ends when you delete the content or your account, apart from backup copies that expire on their own schedule and anything other users have already seen of a post you shared publicly.

6.2 Other people's content

Most of what you save belongs to someone else: a creator's video, a blogger's recipe, a restaurant's photos. Momstash keeps a copy for your own personal, non-commercial reference, a bit like a bookmark that doesn't break. By saving something you confirm that you're allowed to access it, and you agree:

to use saves for your personal reference only, and not to republish, sell or redistribute other people's content that you've saved through Momstash;
that you're responsible for what you save and share, and for following the terms of the websites and apps you save from;
that we're not responsible for third-party content, websites or apps. A link opens the original site under that site's terms and privacy policy.

Please give creators the credit they're due. Momstash keeps the original link and creator name with each save so you can always find them again.

6.3 Copyright complaints

If you believe something in Momstash infringes your copyright or other rights, email [email protected] with: your contact details, what the work is, where it appears in Momstash, a statement that you believe in good faith the use isn't authorized, and a statement that your notice is accurate and that you are (or are authorized to act for) the rights holder. We'll look into it promptly and remove or disable access where appropriate. We may suspend accounts that repeatedly infringe.

7. AI can be wrong

Momstash uses artificial intelligence to transcribe videos and to pull recipes, places, products and other details out of what you save. It's often impressively good, but Momstash can be wrong. It can mishear a quantity, miss an ingredient, skip a step, match the wrong place or product, or show an outdated opening time or price.

Always check the original before relying on a save, especially for anything involving food allergies, dietary needs, cooking temperatures and food safety, children's or babies' products, medicine, health, safety or money.
Nothing in Momstash is medical, nutritional, safety, financial or professional advice.
Prices, availability, opening hours and product details come from third parties and can change or be inaccurate. Momstash doesn't sell anything, and a product link is not our recommendation or endorsement.
"Ask Momstash" only answers from what was extracted from the save, so it can only be as accurate as that extraction.

You use AI-generated results at your own judgment and risk.

8. The Social tab

If you post in the Social tab, you choose who can see each post: only you, your followers, or anyone on Momstash. Please be kind. You're responsible for what you post, and you must not post anything that breaks section 9. You can delete your own posts at any time. We may remove posts that break these terms, and suspend or close accounts that repeatedly do. To report a post or a user, email [email protected] with a description or screenshot and we'll act on reports within 24 hours.

9. What you must not do

Please don't use Momstash to:

save, post or share anything illegal, or anything that sexualizes or endangers children;
harass, bully, threaten, impersonate or hurt anyone, or share someone's private information without their permission;
post hateful, violent, sexually explicit or deceptive content, spam or scams;
infringe anyone's copyright, trademark, privacy or other rights;
mass-download, scrape or archive content, or use Momstash as a tool to redistribute other people's content;
get around the free-access limits, the fair-use limits or the subscription, or create accounts to do so;
reverse engineer, decompile or attack the app or our servers, probe for vulnerabilities (other than responsible disclosure to [email protected]), or overload them with automated requests;
use Momstash or its outputs to build a competing product or to train a machine-learning model;
break any law that applies to you.

10. Our app and brand

The Momstash app, its design, software, text, illustrations and the Momstash name and logo are owned by Mimi Studio or its licensors and protected by copyright and trademark law. We give you a personal, non-transferable, non-exclusive, revocable licence to use the app on Apple devices you own or control, under these terms and the App Store's Usage Rules. Nothing in these terms transfers ownership of any of it to you.

If you send us feedback or ideas, we may use them without any obligation to you.

11. Availability and changes to the Service

We work hard to keep Momstash running, but we can't promise it will always be available, error-free, or able to read every link. Websites and apps change how they work, and some posts are private, deleted or blocked. We may change, add or remove features. If we ever shut Momstash down entirely while you have a paid subscription, we'll give you notice, a way to export your library, and a refund of the unused part of your subscription.

12. Disclaimer

To the fullest extent the law allows, Momstash is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We don't warrant that extracted or AI-generated content is accurate or complete, or that the Service will meet your needs.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intentional misconduct, or for anything else that can't be limited under applicable law. If you are a consumer, your statutory rights are not affected.

13. Limitation of liability

To the maximum extent the law allows, Mimi Studio and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of your use of Momstash.

To the maximum extent the law allows, our total liability arising out of or relating to Momstash will not exceed the greater of the amount you paid for Momstash Pro in the twelve months before the claim, or EUR 50.

Section 12's final paragraph applies here too. Please keep your own copy of anything important, which "Export everything" in Settings → Storage & data makes easy.

14. Indemnity

You agree to indemnify Mimi Studio against third-party claims arising from Your Content, your breach of these terms or your misuse of Momstash. This doesn't apply where a claim results from our own act or omission, or where the law doesn't allow it for consumers.

15. Ending this agreement

You can stop using Momstash at any time, reset your data in the app, and delete your account in Settings → Account & sync → Delete account. We may suspend or close your account if you seriously or repeatedly break these terms, if we must by law, or to protect other users or the Service. Where the breach can be fixed and it's fair to do so, we'll warn you first and give you a chance to fix it. Sections 6.1 (to the extent needed), 7, 10, 12, 13, 14, 16 and 17 survive.

16. Governing law and disputes

These terms are governed by the law of the Republic of Slovenia, without regard to its conflict-of-law rules, and the competent courts of Ljubljana, Slovenia have exclusive jurisdiction.

If you are a consumer living in the European Union or elsewhere, this doesn't take away the protection of the mandatory laws of the country where you live, or your right to bring proceedings there. We'd always rather sort things out directly, so please write to [email protected] first.

17. Apple App Store terms

If you downloaded Momstash from the Apple App Store, these terms also apply:

Parties. These terms are between you and Mimi Studio only, not Apple. Mimi Studio, not Apple, is solely responsible for Momstash and its content.
Licence. Your licence to use Momstash is limited to a non-transferable licence to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Momstash may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where Apple allows it. (Momstash Pro itself is not shareable through Family Sharing.)
Maintenance and support. Mimi Studio is solely responsible for providing maintenance and support for Momstash, at [email protected]. Apple has no obligation whatsoever to provide any maintenance or support.
Warranty. Mimi Studio is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Momstash fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Momstash. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Mimi Studio's sole responsibility.
Product claims. Mimi Studio, not Apple, is responsible for addressing any claims by you or a third party relating to Momstash or your possession and use of it, including (i) product liability claims; (ii) any claim that Momstash fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
Intellectual property. If a third party claims that Momstash or your possession and use of it infringes their intellectual property rights, Mimi Studio, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms. You must comply with applicable third-party terms of agreement when using Momstash, for example your mobile carrier's terms.
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Where these terms and Apple's Licensed Application End User License Agreement differ, these terms apply to the extent Apple allows.

18. General

Entire agreement. These terms and the Privacy Policy are the whole agreement between us about Momstash.
Severability. If any part of these terms can't be enforced, the rest still stands.
No waiver. If we don't enforce something straight away, we haven't given up the right to enforce it later.
Assignment. You may not transfer these terms to someone else. We may transfer them to a company that takes over Momstash, and we'll tell you if we do. Your rights under these terms won't be reduced as a result.
Changes. We may update these terms. If a change matters, we'll tell you in the app before it takes effect. If you keep using Momstash after that, you accept the new terms. If you don't agree, you can stop using Momstash and cancel your subscription.
